Spousal Maintenance Attorneys In Sandton
Section 7(2) Claims, Clean Breaks and Enforcement
After years supporting a household or a career, the question that decides the next decade is narrow: does the divorce leave you with an income, or with nothing at a week’s notice? Spousal maintenance is where that question is answered – permanently if drafted carelessly.
We claim, oppose, enforce and vary spousal maintenance for Sandton clients under the Divorce Act 70 of 1979 and the Maintenance Act 99 of 1998, from our Sandhurst office.

How Section 7(2) Decides Spousal Maintenance
There is no formula. Section 7(2) of the Divorce Act 70 of 1979 lists the factors – the length of the marriage, the parties’ existing and prospective means, age at divorce, the standard of living, and each party’s share in bringing the marriage to an end – and the court weighs them.
A maintenance matter runs through these components:
- section 7(2) factor analysis
- disclosure of means and earning capacity
- rehabilitative, lifetime or clean-break structure
- consent paper or contested order
- enforcement under the Maintenance Act
- variation on changed circumstances
Section 7(2) directs the court to consider eight listed factors before ordering rehabilitative or permanent maintenance, refusing it, or effecting a clean break. Section 7(3) applies a further precondition to marriages out of community of property before 1 November 1984. Once granted, an order is enforced through the Maintenance Act 99 of 1998 – emoluments attachment, attachment of debts and, ultimately, contempt and imprisonment for persistent default.
Two structural truths shape outcomes. First, maintenance is discretionary and fact-heavy: two trials on the same marriage can land differently, which is why settlement papers drafted precisely matter more than fighting rights. Second, a clean-break settlement is drafted, not declared – a consent paper that waives maintenance in vague terms is the waiver the appellate court will uphold.
What a Spousal Maintenance Attorney Does
For claimants: the section 7(2) case built on disclosure – income, earning capacity, the career deferred for the household – quantified into a monthly or capitalised claim and drafted into settlement papers that survive breach.
For payers: the same factors tested from the other side – capacity to pay, the true standard of living, the clean-break structure that caps exposure – and defence of enforcement applications where they overreach.
Maintenance orders are drafted for the month the payment stops, not the month they are granted.
Rehabilitative vs Clean-Break Maintenance
Rehabilitative Maintenance
Time-limited maintenance that carries the claimant to self-sufficiency: retraining, re-entry into a profession, or young children reaching school age.
The duration is the fight. Too short and the order expires into hardship; a properly motivated term reflects the realistic re-entry period.
Lifetime or Clean Break
Permanent maintenance attaches to long marriages where age, health or sacrificed earning capacity make self-sufficiency unlikely; a clean break ends all claims by capitalised transfer.
A clean break suits the payer who can fund a once-off settlement, and the claimant who prefers capital certainty to monthly enforcement risk.
| Feature | Rehabilitative | Lifetime / Clean Break |
|---|---|---|
| Duration | Fixed term, then ends | Until death or remarriage, or once-off |
| Best fit | Shorter marriages, re-entry possible | Long marriages, limited capacity |
| Enforcement exposure | Ongoing during the term | None after clean break |
| Certainty for payer | High; capped by the term | Clean break highest; lifetime lowest |
| Drafting focus | The term and escalation clause | The waiver or the trigger events |
The Process, Step by Step
The pathway, stage by stage.
Consultation and factor mapping
The marriage’s length, roles, ages, means and the section 7(2) factors are set out against the client’s instructions.
Disclosure
Income, assets, earning capacity and the household’s established standard of living are exchanged and tested.
Structure and quantification
Rehabilitative term, lifetime order or capitalised clean break; the monthly figure and escalation are quantified.
Consent paper or trial
Most maintenance terms settle into the divorce’s settlement agreement; disputed claims proceed to trial on the s7(2) evidence.
Order granted
The court grants the maintenance order, or confirms the consent paper, with payment mechanics drafted precisely.
Enforcement or variation
Default is enforced under the Maintenance Act 99 of 1998; changed circumstances ground a variation application.

How to Choose a Spousal Maintenance Attorney in Sandton
The order’s structure outlives the case. Choose accordingly.
- Section 7(2) trial experience.Ask for the factors argued in actual contested maintenance trials, not only settlements.
- High-asset disclosure skills.Sandton estates hide in companies, trusts and bonuses; the attorney must know where income conceals itself.
- Structural fluency.Rehabilitative, lifetime, capitalised clean break – the attorney should explain which structure fits your facts and why.
- Honest outcome talk.No attorney may promise a figure; probabilities grounded in the factors, yes.
- Written scope and fees. Each phase scoped in writing before it begins.
What Spousal Maintenance Matters Cost
As a market guide, maintenance settled within a divorce commonly adds R10,000–R35,000 to the matter; contested maintenance trials from R40,000 upward with counsel and forensic accountants, on hourly rates of R1,500–R4,400. Expert and actuarial reports are typically excluded from attorney quotes.
Otrebski Attorneys scopes each phase in writing before it begins. Ask for the quote in writing and confirm which expert costs sit outside it. No hidden costs.

When the Order Stops Working
The routes back to court
| Situation | Route |
|---|---|
| Payments fall behind | Enforcement at the maintenance court serving the district, the Johannesburg Family Courts or Randburg |
| A salary must be reached | Emoluments attachment order under the Maintenance Act 99 of 1998 |
| Money owed to the payer must be reached | Attachment of debts through the same machinery |
| Default persists | Contempt prosecution, with imprisonment for persistent default |
| Circumstances change materially | Variation application, brought promptly; a clean-break waiver cannot be varied at all |
Frequently Asked Questions
How is spousal maintenance calculated in South Africa?
There is no formula. Section 7(2) of the Divorce Act 70 of 1979 lists the factors the court weighs: the length of the marriage, each party’s means and earning capacity, age, the standard of living during the marriage, and each party’s contribution to it.
What is the difference between rehabilitative and permanent maintenance?
Rehabilitative maintenance runs for a fixed term to carry a spouse back to self-sufficiency; permanent maintenance, now rare outside long marriages, runs until death or remarriage. A clean break ends all maintenance claims in exchange for a capitalised settlement.
Does remarriage end spousal maintenance?
Yes, unless the order provides otherwise: spousal maintenance terminates on the recipient’s remarriage or the death of either party, which is why the trigger events must be drafted into the order.
My ex-spouse stopped paying in Sandton. What can I do?
Enforcement runs through the Maintenance Act 99 of 1998 machinery at the maintenance court serving the district – the Johannesburg Family Courts or Randburg: emoluments attachment orders, attachment of debts, and contempt prosecution for persistent default.
Can a maintenance order be changed after the divorce?
Yes. On a material change in circumstances – retrenchment, illness, retirement – either party may apply for variation. A clean-break waiver cannot be varied; it ends the claim entirely.
Is a wife automatically entitled to 50 percent maintenance?
No. No percentage entitlement exists. The court weighs the section 7(2) factors against both parties’ means; a long marriage with sacrificed career may support a substantial award, a short dual-income marriage may support none.
Which court handles my Sandton maintenance dispute?
Maintenance settled or claimed within a divorce runs with the divorce at the Randburg or Johannesburg courts; enforcement of an existing order proceeds at the maintenance court for the district, and complex matters sit in the Gauteng Division.
Should I take a clean-break settlement or monthly maintenance?
That depends on your risk appetite and the payer’s reliability: capital certainty against enforcement risk. A clean break ends all claims; monthly maintenance preserves income but must be enforced if default starts.
The next decade is in the drafting. Start it properly.
