Antenuptial Contract Lawyers In Sandton

Antenuptial Contracts Drafted, Signed and Registered

An antenuptial contract must be executed before a notary before the wedding and lodged for registration at the Deeds Office – sign it after the vows, and no contract can undo community of property without a court application that may be refused. Couples who start three weeks before the wedding usually make it; couples who start three days often do not.

Our Sandton notarial practice drafts and registers antenuptial contracts – with and without accrual – from the 5th Street, Sandhurst office, and prosecutes postnuptial applications where the window was missed.

Why the Wedding Date Is the Legal Deadline

Marriage in community of property is the default. The ANC must exist before the default arrives.

Every Sandton antenuptial contract runs through the same stages:

  • disclosure of assets and debts
  • accrual or full separation
  • exclusions and commencement values
  • notarial execution
  • Deeds Office registration
  • postnuptial rescue

The Matrimonial Property Act 88 of 1984 governs the system. Without an antenuptial contract, marriage is automatically in community of property: one joint estate, joint creditor exposure. An ANC must be signed before a notary by both parties before the marriage and lodged for registration at the Deeds Office within the prescribed period. After the wedding, the property regime can only be changed on application to the High Court on good and substantial grounds.

The drafting choices matter decades later: whether accrual applies, which assets are excluded, what the commencement values are, and how the contract reads when the marriage ends by death or divorce. Vague ANCs are litigated ANCs.

What an Antenuptial Contract Attorney Does

Before the wedding: disclosure of each party’s assets and debts, the accrual-versus-separation decision explained with actual numbers, exclusions and commencement values captured, and the contract executed before the notary and lodged for registration in time.

After: certified copies for emigration and credit purposes, safekeeping of the original, and where the window was missed, the High Court application to change the matrimonial property system on the court’s terms.

The contract costs thousands. Community of property can cost half an estate.

ANC With Accrual vs Without Accrual

ANC With Accrual

Separate estates during the marriage, with the growth of each shared at death or divorce.

The standard choice: entrepreneurial risk stays in one estate while the marriage shares in success.

ANC Without Accrual

Complete separation – what each brings and earns stays entirely their own.

Suits substantial established estates, second marriages and blended families, but shares nothing by design.

The Procedure

The Contract, Step by Step

The pathway, stage by stage.

  1. Consultation and disclosure – week 1

Assets, debts and business interests on the table; the accrual question answered against real figures, not folklore.

  2. Drafting – days 5 to 12

Accrual terms, exclusions, commencement values and inflation adjustments drafted to survive decades and litigation.

  3. Execution before the notary – before the wedding

Both parties sign before the notary, in person, with identity documents – the step that cannot wait for the honeymoon.

  4. Lodgement at the Deeds Office

The contract is lodged within the prescribed period after execution; registration in the Pretoria Deeds Office records typically follows in 6 to 10 weeks.

  5. Registration confirmed and copies issued

The original is securely stored and certified copies issued for banks, emigration and estate planning – proof of the regime when it matters.

  6. Postnuptial rescue where needed

Already married in community of property? A High Court application on good and substantial grounds is the only route – assessed and prosecuted on its own merits and timeline.

Which Courts Serve Sandton Clients

Sandton civil and criminal matters run through the Johannesburg machinery:

  • Randburg and Johannesburg Magistrates’ Courts – the district seats for Sandton claims, rolls and first appearances.
  • Deeds Office, Pretoria – the registration office serving Gauteng ANCs and postnuptial orders.
  • High Court, Gauteng Division – urgent applications, claims above district limits and appeals.

Otrebski Attorneys serves Sandton clients from its 5th Street, Sandhurst office.

How to Choose an Antenuptial Contract Attorney in Sandton

This contract is read on your worst day. Draft for that reader.

  • Notarial practice.Confirm the firm executes before a notary and lodges at the Deeds Office as routine work, not a favour.
  • Accrual fluency.Ask them to run your numbers both ways. An attorney who cannot explain accrual with your figures cannot draft it.
  • Litigation awareness.Practitioners who fight over ANCs in court draft tighter ones.
  • Timeline honesty.Execution before the wedding is non-negotiable; a firm that says ‘sign whenever’ is misadvising you.
  • Written, itemised fees.Notary fee, drafting and lodgement quoted as one scope in writing.

What an Antenuptial Contract Costs

As a market guide, a drafted, executed and lodged antenuptial contract commonly runs R2,500–R7,000 all-in including notary and lodgement disbursements; urgent or complex drafts with multiple exclusions higher. Postnuptial High Court applications commonly run R25,000–R60,000 with counsel, on hourly rates of R1,500–R4,400.

Otrebski Attorneys quotes the ANC as a single written scope – drafting, execution and lodgement – with disbursements itemised. No hidden costs.

Common Mistakes to Avoid

The expensive mistakes are avoidable.

Signing after the wedding.A contract signed after the marriage does not create an antenuptial regime – the marriage is in community of property regardless of the parties’ intention.
Downloading a template.Generic ANCs with no commencement values or clear exclusions become the disputes they were meant to prevent.
Forgetting lodgement.Execution alone is not the whole step: the contract must be lodged for registration within the prescribed period.
Leaving commencement values blank.Accrual maths without stated starting values is litigation waiting for a divorce.
Assuming the wedding can wait.Notaries need identity documents, both parties and calm; the week of a Sandton wedding rarely supplies all three.
Hiding debts at disclosure. An ANC concluded on concealed facts is exposed to later attack – disclose now or litigate later.

Frequently Asked Questions

What does an antenuptial contract do?

It excludes community of property, keeping each spouse’s estate separate during the marriage – with or without accrual sharing at divorce or death. Without one, a South African marriage is automatically in community of property.

How long before the wedding must we sign the ANC?

It must be executed before a notary before the marriage – the day before suffices legally, but the practical deadline is two to three weeks to allow drafting, disclosure and unhurried signing.

We are already married in community of property – can we change it?

Only by High Court application under the Matrimonial Property Act on good and substantial grounds, with notice to creditors and structure for existing debt. It is possible but never guaranteed – and far costlier than the ANC you did not sign.

We signed our ANC but never heard anything about registration – are we covered?

Check urgently. The contract must be lodged for registration at the Deeds Office within the prescribed period; an unregistered ANC can usually be validated and registered late, but the risk grows with delay. Bring it in for verification.

ANC with or without accrual – which is right for us?

With accrual suits most marriages: separate estates, shared growth. Without accrual suits substantial established estates, second marriages and families wanting complete separation. The honest answer comes from running your actual numbers both ways.

Which Deeds Office registers a Sandton ANC?

Gauteng antenuptial contracts register at the Pretoria Deeds Office, with lodgement handled through the notary who executed the contract.

What does an ANC cost in Sandton?

A complete draft, execution and lodgement commonly runs R2,500–R7,000 including disbursements; postnuptial court applications far more. Quote in writing before you start.

Does an ANC affect my spouse’s business debts?

Yes – that is much of its point. Properly drafted, it keeps one spouse’s creditors away from the other’s separate estate, subject to how the accrual election treats the business.
