How Section 7(2) Decides Spousal Maintenance

There is no formula. Section 7(2) of the Divorce Act 70 of 1979 lists the factors – the length of the marriage, the parties’ existing and prospective means, age at divorce, the standard of living, and each party’s share in bringing the marriage to an end – and the court weighs them.

A maintenance matter runs through these components:

  • section 7(2) factor analysis
  • disclosure of means and earning capacity
  • rehabilitative, lifetime or clean-break structure
  • consent paper or contested order
  • enforcement under the Maintenance Act
  • variation on changed circumstances

Section 7(2) directs the court to consider eight listed factors before ordering rehabilitative or permanent maintenance, refusing it, or effecting a clean break. Section 7(3) applies a further precondition to marriages out of community of property before 1 November 1984. Once granted, an order is enforced through the Maintenance Act 99 of 1998 – emoluments attachment, attachment of debts and, ultimately, contempt and imprisonment for persistent default.

Two structural truths shape outcomes.
